Important Note: The End User Software License Agreement (hereinafter referred to as "this Agreement") is an agreement signed between you (individual, company or any other entity) and OKCAROS Vehicle-Machine Interconnection System (hereinafter referred to as "OKCAROS") on the use of this software (see the definition in Article 1 (1) of this Agreement). You must be of the legal age of majority in your region to access and enter into this Agreement. Please read this agreement carefully before using your OKCAROS device or downloading software updates described in this agreement. Your use of OKCAROS equipment or downloading of this software update will be deemed to have agreed to accept the constraints described in this agreement. If you do not agree to this agreement, please do not use any OKCAROS equipment or download this software update. Under the premise of complying with the product return policy, you can return the OKCAROS device to the exclusive store, or authorized distributor, or retail store where you purchased the device at that time to apply for a refund. However, please note that if you refund to a retail store, you may also need to comply with the store's return requirements. The product return policy is implemented in accordance with the relevant laws and regulations of the country/region of purchase. The software governed by this agreement does not contain open source software components as defined in Article 1(b). You may review a copy of this Agreement at any time by visiting the OKCAROS website (www.okcaros.com) and may retain a copy for future reference.
1. General provisions
（1） Software referred to in this Agreement means:
1. Software components provided to you along with OKCAROS devices, including but not limited to codes and other embedded software, documents, interfaces, content, fonts and any data protected by OKCAROS or its licensors’ copyrights stored on OKCAROS devices;
2. Updates or upgrades to the software described in 1. These software do not contain open source software components as defined in Article 1(2).
（2） OKCAROS devices and/or their updates or upgrades may also contain software components that are protected by third-party copyrights and that are granted open-source software licenses by third parties (hereinafter referred to as "open-source software components"). Such open source software components are distinguished by the license information provided in the device, which also indicates the applicable open source software license for each component. Therefore, when you use these open source software components, the terms and conditions of the open source software license shall apply. This Agreement does not alter any of your rights or obligations under such open source software licenses. In the event of any conflict between the license conditions described in this Agreement and the Open Source Software License with respect to any Open Source Software component, the Open Source Software License shall govern.
（3） Unless otherwise agreed, the software described in this agreement shall be governed by this agreement, whether it is stored in read-only memory, any other medium or in other forms, or from an online download location authorized by OKCAROS.
2. User Software License
Subject to compliance with the terms and conditions of this Agreement, you have the right to use the Software (as defined in Article 1(1)) in a limited, non-exclusive manner on one OKCAROS device, and may not be sold, transferred or used for any other commercial purposes.
3. usage restrictions
（1） Without the prior permission of OKCAROS, it is not allowed to use OKCAROS technology or intellectual property rights to develop software, or design, develop, manufacture, sell or grant licenses to third-party equipment/accessories associated with OKCAROS equipment.
（2） You may make one copy of the Software and store it on your computer hard drive or other storage medium for archival purposes. However, the software may not be distributed or made available over a network so that it can be used by more than one device or computer at the same time.
（3） Without the prior written permission of OKCAROS, the software may not be sold, rented, leased, lent, sublicensed or distributed in whole or in part to third parties. However, you may transfer the entire license of the software once and for all to another party simultaneously with the transfer of the OKCAROS device, provided that:
1. The transfer must include your OKCAROS equipment and all OKCAROS software;
2. Do not keep backups of all or part of the Software;
3. The party receiving OKCAROS equipment and software has read and agrees to accept all the terms and conditions of this agreement.
（4）Unless otherwise expressly permitted, you shall not and will not allow anyone else to copy, disassemble, reverse engineer, decompile, disassemble or create derivative works of the software. In addition, you shall not and will not allow anyone else to conduct or attempt to export the software source code, decode, modify the software or any service provided by the software or any part thereof.
（5）In addition, you agree not to use the software and related updates to engage in the following behaviors:
1. Copy or use any part of the software outside the scope authorized by this agreement;
2. Without the written permission of OKCAROS, provide to third parties, or allow third parties to use all or part of this software (including but not limited to applications, services, codes and source codes operated under this service);
3. use the Software in a deceptive manner or for deceptive purposes;
4. Delete any copyright statement and hint contained in this software;
5. Attempt to destroy, bypass, alter, invalidate or evade any digital rights management system related to the Software and/or an integral part of the Software;
6. Other inappropriate or illegal conduct.
（6） When using this software for storage or copying, you need to obtain the authorization of the relevant obligee in a specific country or region. The material reproduction function provided by OKCAROS software is limited to the reproduction of materials without copyright protection, materials for which you own the copyright, or materials for which you are authorized or legally permitted to reproduce. You understand that title and intellectual property rights in and to any material displayed, stored or accessed through your device belong to the owner of that material. Such materials may be protected by copyright laws or other intellectual property laws and treaties, and may be subject to use agreements or terms of the third party providing such materials. Unless otherwise agreed, this agreement does not grant you any rights to use such materials, nor does it guarantee your continued use of such materials.
（7） You agree to use the software in compliance with all applicable laws and regulations of the country in which the software resides or is used, including but not limited to the local laws of the country in which you reside or download or use the software and services.

OKCAROS and its licensors own and retain all rights and titles to the Software, and reserve any other rights not expressly granted to you in this agreement.
5. use data
（1）If you choose to help OKCAROS improve its products and services by participating in OKCAROS' User Experience Improvement Program, OKCAROS and its affiliates/licensors may collect data from your device for analysis. Data collected includes your device configuration data, application statistics and error log data. All data is anonymized before collection and processing.
（2）OKCAROS ensures an approximate and adequate level of protection for your data as required by all applicable laws and regulations. When you use your device, data collected from your device may be processed or transmitted to OKCAROS and its affiliates/licensors located in countries other than the country in which you live. This means that the data may be transferred to or accessed from jurisdictions other than the country in which you use OKCAROS products or services. These jurisdictions may have different data protection laws, or such laws may not exist.
（3）OKCAROS will only retain your data for the period of time necessary to meet the purposes specified in this Agreement and the Privacy Policy, unless a longer retention period is required or permitted by law. OKCAROS will take all appropriate technical and organizational steps to prevent unauthorized access or disclosure of your data, but be aware that no security measures are completely reliable.
6. Software update
（1）In order to provide you with a better user experience, OKCAROS may provide you with software update services, including but not limited to system software updates and application software updates. The purpose of this software update service is to improve the performance, security and reliability of products or equipment or to meet the needs of operators for functional customization. This software update may be installed in different ways and includes bug fixes, system software updates, application software updates, updates to any previously installed software (including new versions), and performance improvements.
（2）Replacement or supplementary software updates provided by OKCAROS are governed by this Agreement, unless such updates are accompanied by a separate end user license agreement, in which case the latter will be governed. If you decide not to download the update provided by OKCAROS, you understand and acknowledge that you may put the software at serious security risk and may cause the software to be unusable or unstable. Some software functions may be limited by version, so updating to the latest version can improve your user experience.
（3）Your OKCAROS device will automatically search and download the update package through the network to provide you with timely update services. These updates will help you fix network security vulnerabilities and protect against new security threats. You understand the need to receive and install system security updates in a timely manner. Due to the importance of such updates, your device may automatically install some downloaded updates, and update notifications will be issued in time to keep you informed. We strongly recommend that you keep the default configuration of your device to avoid software problems caused by failure to update in time. You also understand that some application software products have an automatic update function, which can automatically download and install an updated version to your terminal device.
7. This software service
（1）The Software may enable you to access related OKCAROS and third-party applications and services that accompany the Software (collectively and individually, the "Services"). However, due to the regional attributes of some services, these services may not be available in various languages or in various regions, and some functions may vary by region, and some may be restricted or not provided by your service provider. Some functions of this software may require a network connection. Unless your device is connected to the Internet through Wi-Fi, this software will use your mobile data to access the Internet and may incur additional charges. Please consult your operator for details. Some services may provide you with various types of information, and OKCAROS and its affiliates/licensors do not guarantee the availability, accuracy, completeness, reliability or timeliness of information displayed on any service, including but not limited to stock information, location information or any other information. In addition, you understand and agree that some functions of this software may be affected or limited by device hardware and data access, and may not be available on all devices.
（2）In order to ensure and improve your user experience, this software has prepared a large number of services for you. The specific content of each service under this software is provided by OKCAROS and its affiliated companies/licensors according to the actual situation. OKCAROS and its affiliates/licensors may change the services they provide, and the content of the services provided may change at any time.
【Location Service】: Location service is the basic function to provide you with location service. Location Services uses GPS, along with crowdsourced Wi-Fi hotspot and cell tower information, to determine your device's approximate location. To use this feature, you must enable "location services" on your device, and each app or website must obtain your permission before using this service. The location service may need to access the network during use, and the traffic fee incurred will be charged by the operator. For details, please consult your operator. You understand and agree that the location data provided by this service is only used as a basic positioning service, and it is not intended to be used in situations that require precise location information, or in situations where incorrect, inaccurate, time-delayed or incomplete location data may cause personal injury, death, property, or environmental damage.
【Wi-Fi+】：Wi-Fi+ is the basic function to provide you with Wi-Fi experience enhancement services. But the service may be dependent on a SIM card in the device, or mobile data being available (in cases where Wi-Fi is not available).
【Weather】: Weather is a basic functional application that provides you with weather information query and forecast services.
8. Third Party Software Notice
（1）Your OKCAROS device may contain certain third-party applications or services. Such third party applications or services may display, contain or make available content, data, information, applications or materials from third parties (“Third Party Software”) or provide links to certain third party websites. OKCAROS does not own such third-party software or its related intellectual property rights, so you acknowledge and agree that OKCAROS does not assume the obligation to provide support for such third-party software, does not guarantee that such third-party software content or services will maintain its availability during any period, and will not be responsible for any content, advertisements, products, services or other materials provided on such third-party software.
（2）You clearly understand and agree that any third-party name, logo, product or service appearing on your OKCAROS device is provided for your convenience only, and does not constitute an express or implied endorsement, guarantee or recommendation of the third party or its software. You further understand and agree that use of any third-party software, including any information or personal data provided by you (whether intentionally or unintentionally), shall be governed by the relevant terms of use, license agreement, privacy policy or other such agreement. Therefore, use of third-party software may be at your own risk.
（3）Unless the third-party software reaches an agreement with you, you agree not to modify, rent, lease, sub-license, distribute services or create derivative works based on the third-party software in any way, and not to use the third-party software in any unauthorized way, including but not limited to using the software to transmit any computer viruses, worms, Trojan horses or other malicious software, or to invade the network or increase the burden on network capacity. You further agree not to use the third-party software in any way to harass, abuse, threaten, slander or use the third-party software in a manner that infringes the rights of any third party, and guarantee that OKCAROS will not be liable for any such actions by you or any harassing, threatening, defamatory, offensive, infringing or illegal information or transmission suffered by you due to the use of the third-party software.
9. Termination and Continuing Effectiveness
（1）This agreement is effective on the first day you install the software. You may terminate this Agreement at any time by permanently deleting, destroying and returning the Software, all backup copies and all related materials provided by OKCAROS at your own cost. If you fail to comply with any term or condition of this agreement, OKCAROS or its licensors have the right to terminate this agreement at any time without prior notice. After termination, you must immediately stop using the software and delete all software and related materials that have been copied and/or installed on your OKCAROS device or computer.
（2）After the termination of this Agreement, Articles 5, 10, 11, 12, 13 and 14 shall remain in effect.
10. Disclaimer
（1）You acknowledge that the software is provided "as is" without warranty of any kind, express or implied, and to the maximum extent permitted by applicable law, neither OKCAROS, its licensors/affiliates, nor copyright holders make any representations or warranties, express or implied, including, but not limited to, warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, confidentiality, and non-infringement of third party rights. Neither OKCAROS nor any other party warrants that the functions contained in the software will meet your requirements, or that the operation of the software will be uninterrupted or error-free. You assume all responsibility and risk for selecting this software to achieve the desired results, and for installing, using, and obtaining the results.
（2）INSTALLATION OF THE SOFTWARE MAY AFFECT THE AVAILABILITY OF THIRD PARTY SOFTWARE, APPLICATIONS OR SERVICES. OKCAROS does not guarantee that the functions or services contained in the software will meet your requirements, nor does it guarantee that the software and its services will be completely error-free/bug-free or will provide continuous and durable services. In addition, OKCAROS does not guarantee that the software will be compatible with any third-party software or services.
（3）You further confirm that the OKCAROS software and services are not suitable for use in situations or environments where failure or time delay of the OKCAROS software or services, errors or inaccuracies in the content, data or information provided therein may result in personal injury or death or serious physical or environmental damage, including but not limited to the operation of nuclear energy facilities, aircraft navigation or communication systems, air traffic control systems, life support or weapon systems.
11. Limitation of Liability
（1）OKCAROS assumes no responsibility for software usage problems caused by misuse, misuse or unauthorized modification.
（2）To the extent permitted by applicable law, OKCAROS, its employees, licensors, or affiliates shall not be liable for any profits, revenue, sales loss, data loss, or costs of procuring substitute goods or services, property damage, personal injury, business interruption, loss of commercial information, or any special, direct, indirect, incidental, economic, punitive, consequential, or contingent damages resulting from the use or inability to use this software, regardless of the legal theory of liability (contract, tort, negligence, or otherwise), even if they have been advised of the possibility of such damages. In certain jurisdictions, limitations on liability for personal injury, incidental or consequential damages may not apply to you, and as such, this limitation may not apply to you.
（3）OKCAROS对您的所有损失承担的总责任赔付限额（除了因OKCAROS过失导致人身伤亡的情况，需遵循适用法律规定）不超过您购买OKCAROS设备所支付的价款。
（4）The laws of some countries do not allow the exclusion or limitation of certain warranties, guarantees or liabilities in an agreement. If these laws apply to you, all or part of the exclusions or limitations stated herein may not apply to you and you may have additional rights. Nothing in this Agreement affects your statutory rights as a consumer or rights that you cannot contractually agree to vary or waive.
12. Technical Support
OKCAROS is not obligated to provide any technical support services for the software described in this agreement beyond what is required by law. Any oral or written information or advice provided by OKCAROS or its authorized representatives does not constitute any warranty. If any defects are found in the software or service, you will be responsible for all necessary repair or correction costs.
13. Dispute Resolution and Governing Law
The verification, interpretation, modification, performance and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China without regard to conflict of law rules. You agree that this Agreement will be signed in Longgang District, Shenzhen. In the event of any dispute concerning the content or performance of this Agreement, it shall be resolved through friendly negotiation. If it cannot be resolved through negotiation, either party may submit the dispute to the people's court with jurisdiction in the place where the agreement is signed for litigation. You are also protected by any mandatory provisions under the laws of your country of residence. Nothing in this Agreement (including the preceding paragraph) affects your rights as a consumer to rely on mandatory provisions under local law.
14. complete agreement
This agreement constitutes the entire agreement between you and OKCAROS governing your use of the software and supersedes any previous agreement between you and OKCAROS regarding the use of the software. When you use or purchase open source software, third-party content or other services of OKCAROS, you may also be subject to other applicable terms and conditions.
重要提示：最终用户软件许可协议（以下简称“本协议”）是您（个人、公司或其他任何实体）与OKCAROS车机互联系统（以下简称“OKCAROS”）就本软件（参见本协议中第一条第（一）项的定义）的使用所签订的协议。您需达到您所在地区的法定成年年龄，方可访问并签订本协议。在使用您的OKCAROS设备或下载本协议中所述软件更新前，请仔细阅读本协议。您使用OKCAROS设备或下载本软件更新将被视为您已同意接受本协议中所述的约束条件。如您不同意本协议，请勿使用任何OKCAROS设备或下载本软件更新。在符合商品退货政策的前提下，您可将OKCAROS设备退回到当时购买该设备的专卖店，或授权分销商，或零售店铺以申请退款。但需要您注意的是，如您向零售店铺退款，可能还需要符合该店铺的退货要求。商品退货政策遵照购买国家/地区的相关法律法规执行。受本协议约束的软件不包含第一条第（二）项中定义的开源软件组件。您可以随时访问OKCAROS网站 （ www.okcaros.com ） 以查看本协议的副本，并可以保留一份本协议的副本以供日后参考。
1. 一般规定
（一） 本协议中所述的软件是指：
1.连同OKCAROS设备一起提供给您的软件组件，包括但不限于存储在OKCAROS设备上的代码和其他嵌入式软件、文档、界面、内容、字体以及任何受OKCAROS或其许可方版权保护的数据；
2.对1中所述的软件进行的更新或升级。这些软件不包含第一条第（二）项中定义的开源软件组件。
（二） OKCAROS设备和/或其更新或升级可能还含有受第三方版权保护并由第三方授予开源软件许可证的软件组件（以下简称“开源软件组件”）。此类开源软件组件通过设备中提供的许可证信息加以区分，这些信息同时还指明了各组件所适用的开源软件许可证。因此，当您使用这些开源软件组件时，应适用开源软件许可证的条款和条件。本协议并不会改变您依据此类开源软件许可证所能享有的任何权利或义务。如果本协议中所述的许可条件与开源软件许可证中有关任何开源软件组件的内容存在任何冲突，应以开源软件许可证为准。
（三） 除非另有其他约定，本协议中所述的软件应受本协议约束，不论其是存储于只读存储器、任何其他介质或属于其他形式，还是来自OKCAROS授权的在线下载位置均是如此。
2. 最终用户软件许可
在遵守本协议条款和条件的情况下，您有权在一台OKCAROS设备上以有限的、非独家的方式使用本软件（如第一条第（一）项所定义），不得出售、转让或用于其他任何商业用途。
3. 使用限制
（一） 未经OKCAROS事先许可，不得使用OKCAROS的技术或知识产权来开发软件，或者设计、开发、制造、销售与OKCAROS设备相关联的第三方设备/附件或授予许可。
（二） 您可以制作一份软件副本并保存在计算机硬盘或其他存储介质上，以用于存档用途。但不得通过网络分发或提供本软件，以致其在同一时间可供多台设备或多台计算机使用。
（三） 未经OKCAROS事先书面许可，不得向第三方出售、出租、租赁、出借、再许可或分发全部或部分软件。不过，您可以在转让OKCAROS设备的同时将软件的整个许可证一次性地永久转让给另一方，条件是：
1. 转让内容必须包括您的OKCAROS设备和所有OKCAROS软件；
2. 不得保留全部或部分软件备份；
3. 接收OKCAROS设备及软件的一方已阅读并同意接受本协议的所有条款和条件。
（四） 除非另有明示许可，您不得且不会允许其他任何人对本软件进行复制、拆装、反向工程、反编译、反汇编或创作软件的衍生作品。此外，您不得且不会允许其他任何人进行或试图进行导出本软件源代码、解码、修改本软件或本软件提供的任何服务或其任何部分等行为。
（五） 此外，您同意不使用本软件及相关更新内容从事以下行为：
1. 在本协议授权范围之外复制或使用本软件的任何一部分内容；
2. 在没有OKCAROS书面允许的前提下，提供给第三方、或者允许第三方使用本软件的全部或者部分（包括但不局限于本服务下运营的应用、服务、代码和源代码等）；
3. 以欺骗的方式或者为欺骗性目的使用本软件；
4. 删除本软件内包含的任何一个版权声明和提示；
5. 企图破坏、绕过、改变、作废或者逃避和本软件相关的以及/或者属于本协软件有机组成的一部分的任何数字版权管理系统；
6. 其他不当或违反法律的行为。
（六） 在使用本软件进行存储或复制时，您需要取得特定国家或地区的相关权利人的授权。OKCAROS软件提供的材料复制功能仅限于复制没有版权保护的材料、您享有版权的材料或者您获得授权或合法许可进行复制的材料。您了解，通过您的设备显示、存储或访问的任何材料，其所有权和知识产权均属于该材料所有权人。此等材料可能受著作权法或其他知识产权法律和条约的保护，并可能需要遵守提供该等材料的第三方使用协议或条款。除非另有约定，本协议并未授予您使用该等材料的任何权利，亦不保证您可继续使用该等材料。
（七） 您同意在使用软件时遵守软件驻留或使用的国家或地区的所有适用法律和法规，包括但不限于您所居住或者下载或使用本软件以及服务的国家或地区的当地法律。
4. 权利保留
OKCAROS及其许可方享有和保留对软件的所有权利和资格，并保留本协议未明确授予您的其他任何权利。
5. 使用数据
（一） 如果您选择通过参与OKCAROS的用户体验改进计划来帮助OKCAROS提升其产品和服务，则OKCAROS及其附属公司/许可方可从您的设备收集数据进行分析。收集的数据包括您的设备配置数据、应用程序统计数据和错误日志数据。所有数据在收集和处理前都会经过匿名化处理。
（二） OKCAROS确保按所有适用法律和法规的要求为您的数据提供近似且足够水平的保护。当您使用设备时，从您的设备中收集的数据可能被处理或传输到OKCAROS及其位于您所居住的国家/地区以外的其他国家/地区的附属公司/许可方。这就意味着，这些数据可能传输到除您使用OKCAROS产品或服务的国家/地区以外的其他司法管辖区或从这些司法管辖区进行访问。这些司法管辖区可能采用不同的数据保护法律，或者可能不存在此类法律。
（三） OKCAROS仅在满足本协议和隐私政策中规定目的所需的时间期限内保留您的数据，除非法律要求或允许更长的保留期限。OKCAROS将采取所有适当的技术和组织步骤以阻止对您数据的未经授权访问或披露，但仍需注意，任何安全措施都不是完全可靠的。
6. 软件更新
（一） 为向您提供更好的用户体验，OKCAROS可能会为您提供软件更新服务，包括但不限于系统软件更新和应用软件更新。本软件更新服务是为了改进产品或设备的性能、安全性及可靠性或者满足运营商功能定制需求。本软件更新可采用不同的安装方式，更新内容包括问题修复、系统软件更新、应用软件更新以及对任何此前安装的软件 （包括全新的版本） 的更新以及性能提升。
（二） OKCAROS提供的替换或补充性软件更新受本协议约束，除非此类更新随附单独的最终用户许可协议，此情况下将受后者约束。如果您决定不下载OKCAROS提供的更新，您理解并认可，您可能将软件置于严重的安全风险，并可能导致软件不可用或不稳定。部分软件功能可能受版本限制，因而更新到最新版本可提升您的用户体验。
（三） 您的OKCAROS设备会通过网络自动搜索和下载更新内容升级包，以为您提供及时的更新服务。这些更新服务将帮助您修复网络安全漏洞，并防范新的安全隐患。您理解及时接收和安装系统安全更新补丁的必要性。鉴于此类更新的重要性，您的设备可能会自动安装某些已经下载的更新，并及时发出更新通知以便您了解相关情况。我们强烈建议您保持设备的默认配置，以避免未能及时更新而导致软件问题。您同时了解，部分应用软件产品具有自动更新功能，可将更新版本自动下载和安装到您的终端设备上。
7. 本软件服务
（一） 本软件可以使您访问本软件附带的相关OKCAROS和第三方应用与服务 （统称及个别称为“服务”）。但由于部分服务存在区域属性，因此这些服务未必能以各种语言或在各个区域提供，某些功能可能因地区而异，有的可能会受到限制，或您的服务提供商没有提供。本软件的某些功能可能需要连接网络，除非您的设备通过 Wi-Fi 连接到互联网，否则本软件将通过您的移动数据访问互联网，并可能因此产生额外费用，详情请咨询您所属的运营商。部分服务可能向您提供各类信息，OKCAROS及其附属公司/许可方不保证任何服务显示的信息，包括但不限于股票信息、位置信息或任何其他信息的可获得性、准确性、完整性、可靠性或及时性。此外，您理解并同意，本软件某些功能的可能还会受到设备硬件及数据访问的影响或限制，并不一定在所有设备上提供。
（二） 为保证并提升您的用户体验，本软件为您准备了大量服务。本软件下各服务的具体内容由OKCAROS及其附属公司/许可方根据实际情况提供。OKCAROS及其附属公司/许可方可以对其提供的服务予以变更，且提供的服务内容可能随时变更。
【位置服务】：位置服务是为您提供定位服务的基础功能。定位服务使用 GPS、以及众包 Wi-Fi 热点和基站信息来确定您设备的大致位置。使用此功能，您须启用您设备上的“定位服务”，且每个应用或网站在使用此服务之前须先获得您的许可。定位服务在使用过程中可能需访问网络，所产生的流量费用由运营商收取，详情请咨询您所属的运营商。您理解并同意本服务提供的位置数据仅作为基本定位服务使用，其目的并非用于需要精确的位置信息的情况，或可能因位置数据错误、不准确、出现时间延误或不完整导致人身伤亡或财产、环境损害的情况。
【Wi-Fi+】：Wi-Fi+ 是为您提供 Wi-Fi 使用体验增强服务的基础功能。但该服务的实现可能需要依赖于设备中 SIM 卡，或移动数据是可用的 （在 Wi-Fi 不可用的情况下） 。
【天气】：天气是为您提供天气信息查询和预报服务的基础功能应用。
8. 第三方软件声明
（一） 您的OKCAROS设备可能包含某些第三方应用程序或服务。此类第三方应用程序或服务可能会显示、包含或提供来自第三方的内容、数据、信息、应用程序或资料（“第三方软件”）或提供指向某些第三方网站的链接。OKCAROS不拥有此类第三方软件或其相关知识产权，因此您承认并同意OKCAROS不承担对此类第三方软件提供支持的义务，并不保证此类第三方软件内容或服务在任何期间维持其可用性，同时也不会对此类第三方软件上提供的任何内容，广告，产品，服务或其他材料承担责任。
（二） 您明确了解并同意，在您的OKCAROS设备上出现的任何第三方的名称、标记、产品或服务仅为方便您提供，并不构成明示或暗示与该第三方或其软件的相关背书、担保或推荐行为。您进一步了解并同意，使用任何第三方软件，包括您提供的任何信息或个人数据（不论是有意或无意地），应受相关使用条款，许可协议，隐私政策或其他此类协议的约束。因此，使用第三方软件可能导致的风险将由您自行承担。
（三） 除非该第三方软件与您达成一致协议，您同意不以任何方式修改，出租、租赁、分售许可、分发服务或创建基于该第三方软件的衍生作品，并且不得以任何未经授权的方式利用该第三方软件，包括但不限于利用该软件进行传输任何计算机病毒、蠕虫、特洛伊木马或其他恶意软件，或侵入网络或加重网络容量负担的行为。您进一步同意不以任何方式利用第三方软件进行骚扰、滥用、威胁、诋毁或以其他侵犯任何第三方的权利的方式使用第三方软件，并且保证OKCAROS不对您的任何此类行为或由于使用第三方软件而遭受的任何骚扰性、威胁性、诽谤性、冒犯性、侵权或非法信息或传输而承担任何责任。
9. 终止和持续有效性
（一） 本协议自您安装软件的首日生效。您可以随时终止本协议，方法是永久删除、销毁并归还软件、所有备份副本以及OKCAROS提供的所有相关材料，并自行承担相应的成本。如果您未能遵守本协议中的任一条款或条件，OKCAROS或其许可方有权在不预先通知的情况下随时终止本协议。终止后，您必须立即停止使用本软件，并删除所有已经复制和/或安装在您的OKCAROS设备或计算机上的软件及相关材料。
（二） 本协议终止后，第五、十、十一、十二、十三和十四条继续有效。
10. 免责条款
（一） 您确认本软件是“按原样”提供，不存在任何形式的明示或暗示担保，并且在适用法律允许的最大范围内，OKCAROS、其许可方/附属公司或版权持有者均不提供任何明示或暗示的陈述或保证，包括但不限于有关适销性、满意质量、适用于特定目的、准确性、保密权以及不侵犯第三方权利的保证。OKCAROS或任何其他方均不保证软件中所含的功能将满足您的要求，也不保证软件的运行不会中断或出错。选择本软件来达到预期结果，以及安装、使用本软件并获取结果所带来的所有责任和风险由您承担。
（二） 安装本软件可能会影响第三方软件、应用程序或服务的可用性。OKCAROS不保证本软件所包含的功能或服务将能满足您的要求，也不保证本软件及其服务能完全无错/无漏洞或将提供连续持久的服务。此外，OKCAROS也不保证本软件将与任何第三方软件或服务兼容。
（三） 您进一步确认，OKCAROS软件和服务不适用于OKCAROS软件或服务出现故障或时间延误、其中提供的内容、数据或信息出现错误或不准确可能导致人身伤亡或者严重的物理或环境损害的情况或环境，包括但不限于操作核能设施、飞机导航或通信系统、空中交通管制系统、生命保障或武器系统。
11. 责任限制
（一） 对于因滥用、错误使用或未经授权修改所引起的软件使用问题，OKCAROS不承担任何责任。
（二） 在适用法律未明令禁止的程度下，对于因使用或无法使用本软件而引起的任何利润、收入、销售损失、数据丢失或采购替代商品或服务的成本、财产损害、人身伤害、业务中断、商业信息损失，或者任何特殊的、直接的、间接的、附带的、经济性、惩罚性、特殊或从属损害，无论是基于何种责任理论（合同、侵权、过失或其他），OKCAROS及其员工、许可方或附属公司都不承担赔偿责任，即使其已被告知存在此种损害的可能性也是如此。某些司法管辖区不允许对人身伤害、附带或从属损害等进行责任限制，则此限制可能不适用于您。
（三） OKCAROS对您的所有损失承担的总责任赔付限额（除了因OKCAROS过失导致人身伤亡的情况，需遵循适用法律规定）不超过您购买OKCAROS设备所支付的价款。
（四） 部分国家/地区的法律不允许协议中排除或限制某些保证、担保或责任。若这些法律适用于您，则本文所述的排除或限制条款的全部或部分可能不适用于您，您可享有额外的权利。本协议中的任何内容均不影响您作为消费者应该享有的法定权利，也不影响您无法通过合同同意变更或放弃的权利。
12. 技术支持
OKCAROS没有义务为您提供法律规定以外的任何针对本协议中所述软件的技术支持服务。OKCAROS或OKCAROS授权代表给予的口头或书面的信息或意见均不构成任何担保。如发现本软件或服务存有瑕疵，您须承担所有必要的维修或纠正费用。
13. 争议解决和所依据法律
本协议的验证、解释、修改、履行和争议解决受中华人民共和国法律的管辖，并不考虑法律规则的冲突。您同意，本协议将在深圳龙岗区签订。如果发生任何有关本协议的内容或履行的争议，则应通过友好协商解决。如果无法通过协商解决，任何一方均可以将争议提交到协议签署地具有管辖权的人民法院诉讼解决。 您还受居住国/地区法律中任何强制条款的保护。本协议中的任何内容（包括上一段) 均不影响您作为消费者依赖当地法律中的强制条款所享有的权利。
14. 完整协议
本协议构成了您与OKCAROS之间达成的管控您的软件使用的完整协议，并将取代之前您与OKCAROS达成的关于软件使用的任何协议。当您使用或购买开源软件、第三方内容或OKCAROS的其他服务时，可能还需遵守其他适用的条款和条件。
